These Terms and Conditions ("Terms") govern your access to and use of Get Out (events.getout.live and related applications, the "Platform"), a curated events and ticketing service, an initiative by ASBL, operated by Tamada Media Private Limited (CIN U74990TG2010PTC069563, GSTIN 36AADCT9766C1Z2) ("Get Out", "we", "us", "our"). By accessing the Platform, creating an account, browsing events, or booking a ticket, you ("you", "user") agree to be bound by these Terms. If you do not agree, please do not use the Platform. 1. Definitions "Platform" means the website events.getout.live, and any associated mobile or web applications operated by Tamada Media Private Limited under the brand "Get Out". "Organiser" means any third party who lists, produces, or hosts an Event on the Platform, other than Get Out itself. "Event" means any show, performance, gathering, or experience listed for booking on the Platform, whether categorised as an Event, an Event by Get Out, or a Get Out Original. "Booking" means a confirmed reservation or ticket purchase made by a user through the Platform. "User", "you", "your" means any individual who accesses or uses the Platform, whether or not they complete a Booking. "Content" means all text, graphics, images, event listings, curation, and other material made available on the Platform. 2. Acceptance of Terms These Terms, along with our Privacy Policy, Refund Policy, and Cancellation Policy, form a binding agreement between you and Tamada Media Private Limited. We may update these Terms from time to time. Continued use of the Platform after an update constitutes acceptance of the revised Terms. The current version, with its "last updated" date, will always be available on the Platform. If any event, organiser, or partner venue has its own additional terms (for example, house rules, dress codes, or entry conditions), those apply in addition to these Terms, and you are responsible for reviewing them before booking. 3. Eligibility The Platform is intended for users aged 18 and above. By using the Platform, you confirm that you are at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872. Some events may carry their own age restrictions (for example, events serving alcohol). It is your responsibility to check and comply with event-specific eligibility criteria; Get Out and the organiser reserve the right to refuse entry if these are not met, without any obligation for a refund beyond what is provided under our Refund Policy. If you are booking on behalf of another person (for example, gifting a ticket), you are responsible for ensuring that person also meets the eligibility criteria for the event. 4. Account Registration To book tickets, follow shows, join waitlists, or enter drops, you may be required to register an account using your name, email address, and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information at registration and to update it as needed. We are not responsible for any loss arising from inaccurate or outdated information you have provided. We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for fraudulent, abusive, or unlawful activity. 5. Nature of the Platform and Relationship of Parties Get Out organises what it offers into three categories: Events: listed by third-party organisers across the city, with Get Out acting as the booking and ticketing partner. Events by Get Out: curated and co-produced by our team alongside a partner venue or artist. Get Out Originals: conceived, created, and run entirely by Get Out (for example, Mic-less and Sneham Kosam). For Events listed by third-party organisers, Get Out acts solely as a booking and payment facilitation platform. The organiser is an independent third party, and nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between Get Out and any organiser, artist, or venue. The organiser is responsible for the conduct, content, quality, safety, and delivery of the event itself. Get Out is not the organiser of, and does not guarantee, warrant, or assume liability for, third-party events beyond the booking and ticketing service we provide. For Events by Get Out and Get Out Originals, Get Out (with its co-producing partner, where applicable) is directly responsible for the event's execution, in addition to the booking and ticketing service. 6. Booking and Ticketing All bookings are subject to availability. A booking is confirmed only once payment has been successfully processed and a confirmation (with ticket and, where applicable, GST tax invoice) has been issued to you. Ticket prices are set by the organiser (or by Get Out, for Events by Get Out and Get Out Originals) and may include applicable taxes, convenience fees, or payment gateway charges, which will be shown to you before you confirm payment. Tickets are issued subject to availability at the time of booking. In the rare event of a technical error resulting in overbooking or a booking confirmation for an unavailable slot, we will notify you and issue a full refund for that booking. Some events may be offered through waitlists, drops, or lotteries. Entry into a waitlist, drop, or lottery does not guarantee a ticket; allocation is made in line with the process described for that specific event (for example, a fair queue or randomised draw). Certain tickets may be ID-locked and non-transferable, meaning entry is granted only to the person named on the booking, verified by a valid photo ID at the venue. Where a ticket is ID-locked, it cannot be transferred, resold, or used by anyone other than the original booker. You are responsible for reviewing all event details — date, time, venue, age restrictions, and any organiser-specific conditions — before completing a booking. Get Out is not liable for a booking made in error due to your own oversight, though our team can be reached at info.getoutasbl@gmail.com for assistance. Tickets may not be resold above face value, or resold, bartered, or advertised for resale on any third-party platform, without our prior written consent. We reserve the right to cancel, without refund, any booking or ticket found to have been acquired or resold in violation of this clause. 7. Payments Payments on the Platform are processed through our third-party payment gateway, Razorpay. We do not store your full card, UPI, or bank account details on our systems; these are handled directly and securely by Razorpay in accordance with its own terms and security standards. By making a payment, you also agree to Razorpay's applicable terms of service. A GST tax invoice is issued for each paid booking by Tamada Media Private Limited under its invoice series, in line with applicable GST law. We are not responsible for any delay, failure, or error in payment processing caused by your bank, card issuer, UPI provider, or the payment gateway, though we will assist in resolving any booking discrepancy arising from such an error. 8. Cancellations and Refunds Cancellations and refunds are governed by our separate Cancellation Policy and Refund Policy, which form part of these Terms by reference. Please review them before booking. In summary: eligible bookings can be self-cancelled up to 24 hours before an event's start time, subject to a deduction of the payment gateway fee; bookings cancelled by the organiser or by Get Out are refunded in full; and certain bookings (free-entry events, passes marked non-refundable or non-cancellable, and bookings within the 24-hour window) are not eligible for cancellation or refund. 9. Event Changes, Postponement, and Cancellation Organisers (or Get Out, for Events by Get Out and Get Out Originals) may need to change an event's date, time, venue, lineup, or format, or cancel it entirely, due to circumstances including but not limited to artist unavailability, venue issues, low demand, safety concerns, government or local authority directives, or force majeure events. Where an event is rescheduled, your ticket remains valid for the new date; if you are unable to attend, you may request a cancellation and refund under our Refund Policy. Where an event is cancelled, you will be notified and issued a full refund with no deductions, as described in our Refund Policy. Get Out will make reasonable efforts to notify you of any change or cancellation using the contact details on your account, but is not liable for any indirect loss or expense (such as travel, accommodation, or other arrangements made around the event) arising from such a change. 10. Entry and Conduct at Events Entry to an event is subject to presenting a valid ticket (and, where required, a matching photo ID) at the venue, along with compliance with any venue or organiser-specific rules (dress code, age restriction, prohibited items, security checks, etc.). Get Out, the organiser, and the venue reserve the right to refuse entry or remove any attendee whose conduct is disruptive, unsafe, unlawful, or in violation of venue rules, without obligation to refund the ticket price except as provided under our Refund Policy. You agree to behave lawfully and respectfully at all events, and to comply with reasonable instructions from venue staff, security, and organisers. Get Out is not responsible for the loss, theft, or damage of personal belongings at any venue, or for any injury or loss arising from your own conduct or violation of venue rules. 11. User Conduct on the Platform You agree not to: Use the Platform for any unlawful purpose, or in a way that infringes the rights of Get Out, an organiser, an artist, or any other user. Attempt to circumvent booking limits, waitlists, drops, or lottery mechanisms through automated tools, bots, multiple accounts, or other unfair means. Resell, transfer, or misrepresent tickets in violation of these Terms or an event's specific transfer conditions, particularly for ID-locked tickets. Upload or transmit any content that is unlawful, defamatory, obscene, or infringes any third party's intellectual property or privacy. Attempt to gain unauthorised access to the Platform, its systems, or other users' accounts. Misuse the Platform's customer support, waitlist, or refund processes in a fraudulent or abusive manner. 12. Intellectual Property All content on the Platform — including the Get Out name, logo, curation, descriptions, design, and the "Fine Dining, The Stage, Crafts, Spaces, Stories, Jamming" categorisation system — is the property of Tamada Media Private Limited or its licensors, and is protected under applicable intellectual property laws. Event-specific content (artist names, images, performance material) may belong to the relevant organiser or artist and is used with their permission. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our prior written consent, except for personal, non-commercial use in connection with a booking you have made. 13. Third-Party Links and Services The Platform may contain links to third-party websites or services (including organiser pages, social media, or the Razorpay payment gateway). We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Your use of any third-party service is subject to that party's own terms and policies. 14. Disclaimers The Platform and its content are provided on an "as is" and "as available" basis. While we take reasonable care to curate accurate and up-to-date listings, we do not warrant that event details, availability, or descriptions are error-free, complete, or uninterrupted at all times. For Events listed by third-party organisers, Get Out makes no warranty regarding the quality, safety, legality, or fitness of the event itself, which remains the organiser's responsibility. We do not guarantee uninterrupted or error-free access to the Platform and are not liable for any downtime, technical failure, or loss of data arising from circumstances outside our reasonable control. 15. Limitation of Liability To the maximum extent permitted by applicable law, Tamada Media Private Limited's total liability to you for any claim arising out of or relating to your use of the Platform or a booking shall not exceed the amount you paid for the relevant booking. We shall not be liable for any indirect, incidental, consequential, or special damages, including loss of enjoyment, travel or accommodation costs, or loss of data, arising from your use of the Platform, an event, or any act or omission of a third-party organiser or venue. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable Indian law, including under the Consumer Protection Act, 2019. 16. Indemnification You agree to indemnify and hold harmless Tamada Media Private Limited, its officers, employees, and partners from any claim, loss, liability, or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Platform, or your conduct at an event. 17. Force Majeure Get Out and its organisers shall not be liable for any failure or delay in performance caused by circumstances beyond reasonable control, including but not limited to natural disasters, government action, public health emergencies, strikes, power or internet outages, or venue unavailability. Where such circumstances affect a booked event, the provisions of Section 9 (Event Changes, Postponement, and Cancellation) will apply. 18. Privacy Your use of the Platform is also governed by our Privacy Policy, which explains what personal data we collect, how we use it, and your rights regarding it. By using the Platform, you consent to the collection and use of your data as described there. 19. You may also approach the National Consumer Helpline or the appropriate consumer forum under the Consumer Protection Act, 2019, if a grievance remains unresolved. 20. Notices Any notice required to be given under these Terms shall be in writing and sent by email — to info.getoutasbl@gmail.com for notices to us, and to the email address registered on your account for notices to you — or by post to the addresses listed in these Terms. Notices sent by email are deemed received on the date of transmission, subject to no delivery failure notification. 21. Assignment You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets, provided your rights under these Terms are not materially diminished as a result. 22. Waiver No failure or delay by Get Out in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise of a right preclude any other or further exercise of that right or any other right. 23. Governing Law, Arbitration, and Dispute Resolution These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Platform shall first be attempted to be resolved amicably by writing to info.getoutasbl@gmail.com, within 30 days of the dispute arising. If the dispute is not resolved amicably within 30 days, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, and any statutory amendment or re-enactment thereof for the time being in force. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties, or, failing agreement within 15 days, appointed in accordance with the Act. The seat and venue of arbitration shall be Hyderabad, Telangana, India, and the language of arbitration shall be English. The arbitral award shall be final and binding on both parties. Subject to the arbitration agreement above, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over any matter not subject to, or arising in connection with, the arbitration (including applications for interim relief). Nothing in this clause shall prevent you from approaching a consumer forum or the National Consumer Helpline under the Consumer Protection Act, 2019, where applicable law entitles you to do so notwithstanding an arbitration agreement. 24. Severability If any provision of these Terms is found to be invalid or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. 25. Entire Agreement These Terms, together with our Privacy Policy, Refund Policy, and Cancellation Policy, constitute the entire agreement between you and Tamada Media Private Limited regarding your use of the Platform, and supersede any prior agreements or understandings, whether written or oral, relating to that subject matter. 26. Language These Terms are drawn up in English. Any translation provided is for convenience only, and the English version shall prevail in the event of any inconsistency. 27.
